Clients, advisors and the Competition Bureau are all facing increased cost and complexity in dealing with document production in response to SIRs, s. 11s, and, in litigated cases, documentary discovery obligations. The exploding volume of data and documents is also coinciding with the Federal Court of Appeal’s revisiting of public interest privilege in the VAA case.  

This panel will present four different perspectives on these issues: from the viewpoint of the Bureau, parties who respond to Bureau requests for documents, parties who litigate against the Bureau, and the external e-discovery advisors who execute the searches and productions.
