Almost every other day we see headlines about major privacy breaches, which are often followed by the initiation of class actions. Join us to canvass the intersectionality of these two areas of the law and what might lie ahead for practitioners in these areas. Our stellar faculty will discuss and analyze the following:
- The latest developments in privacy class actions law
- The common issues underlying several recent failed certification motions, particularly judicial considerations of compensable damages
- What is the future of privacy torts in Ontario, and how will it affect the flurry of new proposed privacy breach class actions which have been filed
- Evolving conceptions of “privacy” in the broader Canadian jurisprudence and what insights can be drawn in the class actions context from recent Supreme Court considerations of what privacy actually means
- Whether we have a jurisprudential model that is capable of grappling with how to value privacy in the civil law context
