Non-traditional franchise relationships offer both unique opportunities and challenges for the franchisor and the franchisee. These relationships range from “grab and go” locations, to locations inside venues such as gas stations, retail stores, hospitals, universities and airports, to co-branded sites. Our experienced panel will examine business and legal issues associated with these non-traditional franchise relationships including:
- Defining what comprises a non-traditional location and identifying the core competency of the host location
- Identifying the right franchisee to operate in the location, including what skill set is required and the nature of start-up costs
- Discussing the unique disclosure issues
- Understanding the different negotiating dynamics
- Exploring the special issues around territory, exclusivity and restrictive covenants
- Examining the operations issues that exist (e.g. modification of hours, equipment, procedures, products and services, training)
