Join us for this unique series where past winners of the OBA Murray Klein Award discuss precedent-setting cases in which they were involved, or new concepts and practices in Canadian insolvency and restructuring law where they were at the forefront. This award recognizes Ontario insolvency and restructuring lawyers for their integrity, decency and selflessness in their approach to professional practice. Each panel in this not-to-be-missed series will also consider how concepts introduced in years past have evolved.

Inherent Jurisdiction You Say? – How the DIP Order in Dylex Came to Pass

Mr. Justice Houlden’s decision in Dylex Ltd. offers the original authority for the subordination of pre-existing security over the assets of a CCAA debtor in favour of a proposed DIP financier, over the objections of existing secured creditors.  Our speaker will provide valuable context for the significant decision in Dylex Ltd. and discuss its impact on financing of restructuring proceedings today.
