We kick off our four-part procedural series by addressing arguably the most important phase of a legal matter: pre-litigation negotiation.   Lawyers know that early resolution is often exactly what the client desires.  Lawyers also know that the vast majority of employment law matters are settled before trial.  Set yourself on the probable course of early resolution by understanding the tricks of the trade associated with handling pre and early-litigation processes.   Our faculty will share their knowledge and insight on optimizing negotiation tactics from the start of a file by addressing:

  • writing an effective demand letter
  • managing phone calls with opposing counsel
  • negotiation strategies
  • pre-litigation alternative dispute resolution

You will also gain practical advice on determining the best venue to initiate proceedings and when to initiate litigation should early resolution prove impossible.
