- The role of complainant's counsel during third party records applications
It is increasingly more frequent to see complainants retaining private counsel. Also with the new pilot project offering free legal advice to complainants of sexual assault, questions abound regarding the murky area of the proper role of counsel for the complainant, and what part they play in the course of the case.
- The ethics of stepping around confidential informant (CI) privilege & "confidential informant" vs. "agent"
This area can be a minefield for even experienced counsel. What do you do when you believe your CI is really an agent, or that the privilege has been improperly applied? What are the limits of cross-examination around CI privilege?
- Prepping a witness
How far can you go? What are some "do's and don'ts"? It is important to understand the line without crossing over it.
