A Constitutional Analysis of Carter and Medically-Assisted Dying
Constitutional, Civil Liberties and Human Rights Law | Original Program Date: June 15, 2016

In Carter, the Supreme Court of Canada (“SCC”) found the Criminal Code provisions prohibiting physician-assisted dying to be unconstitutional, but suspended the declaration for a year to allow the Government to respond legislatively. That legislation was introduced on April 14, 2016, following the granting of a four-month extension by the SCC earlier this year, and continues to prove challenging in House of Common debates. Medical regulators have stepped in with their own guidelines. Join us to make sense of the new landscape as we explore the constitutional implications of the SCC decisions in Carter and the legislative and regulatory response, including:

  • An unusual remedy: Unraveling the SCC’s decision to grant the requested extension with express exceptions
  • Does the new legislation fully address the SCC’s ruling? Or can we expect new challenges?
  • Challenges of balancing patient and physician rights
