Procurement Commitments under International and Domestic Trade Agreements

View this program and understand how your clients (corporate, individuals, and all levels of government) are impacted by the procurement provisions under trade agreements - what opportunities and dispute settlement mechanisms are available to them and other bidders? This program will discuss the scope of procurement commitments under the WTO GPA, CETA, TPP, and the AIT, including unprecedented coverage of federal, provincial and municipal procurement under new generation agreements. This expanded coverage will require proper dispute settlement mechanisms to be in place, which depart from typical state-to-state dispute settlement under trade agreements and, instead, will provide individual bidders, whether a person or company, with the right to challenge certain procurements. Our expert speakers will dive in to:
- The scope of procurement commitments under trade agreements – how they have expanded in new generation agreements;
- The rights and obligations of both foreign and domestic bidders under these agreements at both the federal and sub-federal level;
- The implementation of bid protest mechanisms to meet current and new commitments (e.g. CITT, domestic courts and possible future adjudicative bodies).
