Sometimes a charity receives funds with a restriction, which may be impossible or impractical to implement, thus creating significant problems for the charity either now or in the future. Charities and others holding charitable property may seek through either the court system or a simplified process with the Ontario Public Guardian and Trustee to have the court amend the restrictions, which can be an expensive process. Also, there is no guarantee of success as courts are reluctant to alter restrictions.
