Who Is a Spouse? Navigating and Avoiding Spousal Claims on Death

It is not uncommon in estate matters to be faced with a claim by a spouse and in some cases, claims involving more than one spouse.  Claims may also arise against the estate as a result of other romantic relationships of the deceased prior to death.  Carrigan v. Carrigan is but one example of the competing claims that can arise between multiple spouses and resulted in recent legislative reform to the Pension Benefits Act.
