Legislative Update: Pre-Retirement Death Benefits Following Recent Pension Benefits Act Amendments

In October 2012, the Court of Appeal’s decision in Carrigan v. Carrigan turned the priority scheme for pre-retirement death benefits on its head. Ontario has recently passed amendments to the Pension Benefits Act to ameliorate the decision following significant advocacy efforts by the OBA Pensions, Family, and Trusts & Estates sections. The amendments came into force on July 24, 2014. Join us to get up-to-speed on what is new, what has changed and where we now stand on issues including:
