The rules of the game for distribution and pricing practices are changing - ensure you are in the loop. The 2009 amendments to the Competition Act that repealed the criminal price and promotional allowance provisions, enable distributors to have greater influence on down-stream resellers. However, the Commissioner of Competition's recently issued draft Enforcement Guidelines on price maintenance suggest that issues still exist. Terminating a distribution agreement can be fraught with even more risk, both under the Competition Act and developing case law.
