Fixing Broken Trusts

At times, we are faced with situations where a testamentary trust contains a drafting error not discovered until after the death of the testator or with a trust where unexpected circumstances, such as an unpredicted order of family deaths, is about to lead to unintended results. Our experienced faculty will explore the use of the rectification remedy and variation of trusts legislation as methods of solving these problems. Consideration will be given to the role of LawPro, the Rules of Professional Conduct, and the roles of the Office of the Children's Lawyer and the Public Guardian and Trustee in these sorts of proceedings.
