"Assessing Incapacity in a Digital World” - Taking Instructions from Your Client
Over the last two years, the global pandemic and the growth in technology have transformed the solicitor-client relationship to now permit video conferencing for meetings and the execution of estate planning documents across Canada. Assessing the client’s legal capacity and taking client instructions online have never been more challenging.
This program will focus on new remote execution rules across the provinces, assessing undue influence, and reviewing incapacity requirements.
We will also hear from a geriatric psychiatry specialist who will provide a medical perspective and opinion on capacity assessments, along with the Director of PracticePro to address risk management and emerging claims against solicitors who are taking client instructions in this digital world.
All solicitors who are engaged with vulnerable clients will benefit from this program.
