This program will deal with the challenges of managing the civil and criminal aspects of a live cartel investigation that has spawned parallel class proceedings in Canada and the U.S. The panelists will engage in an in-depth discussion of how the proposed changes to the Bureau’s Immunity Program may influence participation in the Program and what defence counsel must now consider when advising clients who face both criminal and civil exposure. The panel will also explore the practical aspects of managing disclosure of information to the Bureau and the PPSC in a cartel case as well as the ability of class plaintiffs to access such information in the hands of the defendants or the Bureau. In addition, the panel will discuss the plaintiffs’ side of a cartel case including the challenges of working with (or litigating carriage against) competing Canadian plaintiffs’ firms, managing numerous large and complex cases (i.e., the sprawling auto parts cases), and working with US plaintiffs’ firms.
