The CBA Competition Law Section’s Criminal Matters Committee and Marketing Practices Committee present:

Criminal Deceptive Marketing Practices:
The Criminal Threshold under Section 52 of the Act

April 27, 2018 | 12:00-1:15 PM Eastern | Teleconference

The Competition Act contains two adjudicative regimes to address deceptive marketing practices – a civil and a criminal regime. While there have only been a handful of criminal prosecutions, the potential penalties are significant.

Join our panel for an in-depth discussion of the criminal regime, including an overview of the deceptive marketing offences in the Competition Act, the dual track review process and the challenges in prosecuting and defending an offence under section 52. The panel will also include prosecution and defence perspectives from two veterans of the R. v. Stucky prosecution, still one of the leading criminal deceptive marketing cases under the Act.

Moderator
Sandeep J. Joshi, BMO Financial Group

Speakers
Andrew Little, Bennett Jones LLP
David Porter, McCarthy Tétrault LLP
Nicola Pfeifer, Competition Bureau
