On October 15, 2024 the Supreme Court of Canada heard the appeals of two youth who had been sentenced as adults, pursuant to section 72 of the Youth Criminal Justice Act in R v IM and R v SB. Courts across Canada have long struggled with the section 72 provisions--provisions which are arguably the most important provisions within the YCJA, given the serious jeopardy that goes along with the imposition of an adult sentence.
These monumental appeals caught the attention of youth law practitioners, experts, and academics. The SCC's forthcoming decision will surely provide clarity and guidance on the issue of adult sentences specifically, and on the fundamental of youth criminal justice as a whole. The cases of R v IM and R v SB attracted numerous intervenors including the two panelists featured in this presentation, Mary Birdsell of Justice for Children and Youth and Brandon Rolle of African Nova Scotian Justice Institute.
