Synopsis
The Robinson-Superior and Robinson-Huron Treaties of 1850 contain a unique augmentation clause linking annual treaty payments to revenues from the territory. In the recent Restoule decision, the Supreme Court of Canada held the Crown has failed to honour its treaty promise to share in the wealth of the land for the past 150 years and ordered the Crown to fairly compensate the Indigenous signatories.
Alexander Kirby, legal counsel for the Superior plaintiffs, provides insight into this landmark decision and answers your burning questions.
