Challenges Facing Both Child Counsel and the Court in the Representation of Children and Best Practices to Support and Promote the Importance of this Role Before the Court

On Demand. Originally presented on November 28, 2024.

This presentation will be of assistance to all family practitioners, lawyers who represent children as well as lawyers that represent parents where counsel is appointed to represent the children, in providing a better understanding and appreciation of the difficulty in representing Children.

Justice Linton during her presentation, referred to two cases. The cases are on assessing evidence of child witnesses in a criminal context but given the higher burden of proof in the criminal context, the cases should provide some guidance in both family and civil cases:

R v DF 2024 SCC 14, ADOPTED THE DISSENT IN Ontario CA of same initials
R v Thompson 2024 ABKB 411 Justice Renke provides a succinct review

SPEAKERS

The Honourable Justice Kathleen Linton (Alberta Court of Justice)
