Text Messages: A Tangled Web of Legal Issues

Texting has become a ubiquitous form of communication, and the automatic preservation of these messages can be a rich source of evidence in a criminal trial. At the same time, text messages fit awkwardly into the various evidentiary and procedural rules, most of which predate the invention of the smart phone. As a result, text messages raise of host of potential legal issues. This session will provide an overview of these issues and advice on navigating them.
