Guidance on Section 24(2) of the Charter Since R v Grant

It has been 15 years since the Supreme Court of Canada released R v Grant, its seminal case on the exclusion of evidence under section 24(2) of the Charter. Since then, the SCC has interpreted, applied, and attempted to refine its test for exclusion in a number of important decisions. Emma Toporowski, former clerkship student at the Court of Justice and current articling student at Purser Law, will review the Supreme Court’s jurisprudence on section 24(2) since Grant and provide a framework for analysis to guide you in your cases.
