A Troubling Menagerie: Abusive Litigants and How To Manage Them

The stereotypic label for Canadian problematic litigants - “vexatious” - misrepresents the characteristics and motivations of these persons. Instead, most problematic litigants are functionally “abusive”. They misuse court and tribunal processes for what the problematic litigant views as a valid, if not necessary, purpose. Dr. Donald Netolitzky K.C. is the Complex Litigant Management Counsel for the Alberta Court of King’s Bench.
In this seminar he describes abusive litigation and litigants, examining:
- What we know about self-represented litigants (SRLs) and their relationship to abusive litigants,
- Five abusive litigant types,
- “Traditional” versus “Modern” approaches to problematic litigation and litigant management, and
- Court processes and techniques to mitigate abusive litigation and litigants, and their effects.
