This panel will provide a brief history of the legislation governing environmental/impact assessment at the federal level. Speakers will also address key topics and issues respecting the current regime, including: (i) recent cases; (ii) regional and strategic assessments; (iii) rights of Indigenous peoples in impact assessment; (iv) energy and resources development; (v) other policy/political imperatives affecting impact assessment; and (vi) other developments garnering attention including permitting under the Fisheries Act and Species at Risk Act.

The U.S. system of environmental protection is at a key inflection moment as the U.S. Environmental Protection Agency and several major U.S. environmental statutes recently turned 50, and the Bipartisan Infrastructure Law and Inflation Reduction Act pump billions into projects and communities. What challenges and opportunities will face the U.S. environmental system today and over the next decade? This discussion will reflect on emerging contaminants, water and air quality, cooperative federalism, enforcement, and the changes afoot as a new generation of environmental leaders take their seats.

Environmental Legislation at the Federal Level: Other Key Developments in the Last 30 Years
This Panel will explore the central importance of fish and fish habitat protection and pollution prevention measures under the Fisheries Act, changes to the navigable waters protection regime and a broader look at general enforcement-related issues.
The panel will also present a brief history of law reform to CEPA and its regulations in response to emerging knowledge in science. In addition, the panel will address historical efforts to address climate change in Canada, and the role of carbon pricing strategies in policies to reduce GHG emissions under the Greenhouse Gas Pollution Pricing Act.
