Recent legislative developments and an abuse of dominance application for leave have put a spotlight on private access to the Competition Tribunal. Join our panelists for a discussion of the proposed legislative amendments that will expand private access to include agreements that substantially lessen or prevent competition, introduce restitution for private applicants and others affected by reviewable conduct, require parties to provide the Commissioner with agreements related to a discontinuance, and reform the substantive test for leave to bring a private proceeding. The panelists will also touch on whether the proposed amendments will mean Canada's private litigation experience will look more like the United States', the interplay between private applications and the Competition Bureau, and what the Competition Bar can take away from Apotex's recent abuse of dominance application for leave and discontinuance.
