Competition Act amendments: Who’s proposing what, and why? |

The public discussion around amendments to the Competition Act has been ongoing for the past several years, and the suggestions for reform are numerous. What are proponents of Competition Act amendments seeking to achieve, and why? This panel is intended to examine broader themes around the purpose of competition law, discuss why certain changes are being proposed now, and encourage a conversation on how we think about competition policy.

Parallel Merger Review |

There are a number of other regulatory bodies that may conduct review of merger transactions that run parallel to competition merger review. These parallel reviews create implications for timing, strategy and risk that competition counsel should consider when advising clients. This panel will focus on the relationship between competition merger review and reviews enacted under other statutes including the Broadcasting Act, Canada Transportation Act, Investment Canada Act, and prospective changes to the Retail Payments Activities Act.

Developing Competition Compliance Programs 101 |
|
Implementing a competition compliance program can, in certain circumstances, be ordered by a court, agreed to in a consent agreement or required as part of an alternative case resolution as a condition of the Bureau not pursuing enforcement action. Further, the courts and the Bureau may take the pre-existence of credible and effective compliance programs as a mitigating factor when assessing remedies in the event of a breach of the Act. This session is intended to bring you up to speed on the key elements of creating a credible and effective competition compliance program, with a particular focus on the essential elements from the Competition Bureau’s perspective. Practitioners will also share some tips and tricks to create programs that are digestible for busy businesspeople.
