In its long-awaited decision in Canada (Commissioner of Competition) v Parrish & Heimbecker, Limited, the Competition Tribunal ruled on a number of foundational questions under Canadian merger law, including the proper approach to product market definition, the standard for determining whether a merger has lessened competition “substantially”, and the evidentiary burden on merging parties to prove efficiencies claims. In addition, the case also involved several unique procedural issues ranging from the confidentiality of witness identities to the “hot-tubbing” of expert witnesses.
