Adjudication vs 'In-Project' Dispute Resolution in Construction – Perspectives
Construction projects are built on the credit of contractors, subcontractors and suppliers. Cash flow is a dynamic issue which can lead to disputes. In order to mitigate delays in payment down the construction pyramid, many Canadian jurisdictions are considering implementing adjudication and prompt payment regimes to their lien legislation.
Currently, only Ontario has implemented such requirements in its Construction Act, while Quebec is undertaking a trial basis for certain types of disputes and projects. What are the pros and cons of adjudication versus in-project contractual dispute resolution?
