The Minister of Innovation, Science and Industry has announced an intention to consider possible amendments to the Competition Act, including to “increase access to justice for those injured by harmful conduct”. And the Competition Bureau has advocated in favour of a private right of access to the Competition Tribunal for abuse of dominance and competitor collaborations cases. 

What should a new legislative regime look like? Should the requirement to obtain leave to bring cases be retained, or modified? Should a private right of action for damages be created?

If so, what should its constituent elements be? What lessons can we learn from the current regime and the American experience?
