This session will address the recent SCC decision, Nelson (City) v. Marchi, 2021 SCC 41. The two lawyers who represented the City of Nelson at the Supreme Court of Canada will speak about (1) the policy versus operational dichotomy; (2) the impact this decision will have on government litigation; and (3) what needs to be considered as new government policies are created or old ones revised.

Greg Allen, Founding Partner, Allen / McMillan LLP
Prior to founding Allen / McMillan, Greg clerked at the British Columbia Court of Appeal and practiced for eight years at one of the top-rated litigation boutiques in Canada. He maintains a broad civil and commercial litigation practice, with particular expertise in shareholders' remedies, defamation, municipal law and administrative law. He also maintains an appellate advisory and appellate advocacy practice, having been counsel on numerous cases at the British Columbia Court of Appeal. He has made eight appearances at the Supreme Court of Canada, including six as lead counsel.

Liam is an associate at Allen / McMillian. He assists clients with a broad range of commercial and civil disputes, including contractual disputes, shareholder disputes and property disputes. Liam has appeared at all levels of court in British Columbia and at the Supreme Court of Canada. Prior to joining Allen / McMillan, Liam articled at a boutique business law firm which specialized in solicitor side work. While in law school, Liam won the course prize in Contracts and won the “Best Lawyering Award” for his advocacy in his law school’s legal clinic.
