Significant pressure is building across the globe for major investigations and enforcement actions relating to the digital economy, particularly in respect of major global platforms.
However, the “winner take most” reality of digital markets, particularly those involving digital platforms, presents a unique systematic challenge to effective competition policy. In an arena where competition laws may not be able to prevent terminal harm to emerging businesses and where expected penalties for non-compliance are relatively small, is it better to have succeeded and face antitrust scrutiny, or to have failed and watch your (very rich) competitor face that scrutiny instead?
This panel will explore the current investigatory and enforcement landscape facing “big tech”, and discuss existing and potential tools available to the Competition Bureau to both address current issues in “big tech” and proactively address emerging issues.
