Can competition law support or even complement environment policy and practice?
For the past 35 years, Canadian competition law has focused on consumer welfare and economic efficiency. Will a merger lead to higher prices and/or substantial cost efficiencies? Will an industry association policy create entry barriers that increase prices and reduce output? Are competitors agreeing not to supply certain products to consumers below a minimum price?
As the world begins to recognize climate change as one of the great challenges of the 21st century, many are asking whether environmental considerations should be integrated in competition policy or whether we are better served by continuing to separate these two critical pillars of national policy.
This panel will explore the intersection between competition law and environmental policy to assess the extent to which Canada’s current laws can respond, as needed, to both areas. Or could we even find an avenue whether they are complementary, and stronger for it?
