The presentation will deliver an overview of the principles flowing from the Supreme Court’s December 2019 judgement in Vavilov, which provided a revised approach to judicial review in Canada. It will focus on how reviewing courts in various jurisdictions have applied Vavilov’s judicial review framework. With six months’ worth of case law, interesting and practical trends have emerged, including with respect to the role of reasons and expertise in administrative law. This session will be a useful primer and update on the new regime of judicial review in Canada.

Speaker
Michael Marin is Associate Dean and Associate Professor at the University of New Brunswick Faculty of Law. He is also a Vice-Chairperson of the Workers’ Compensation Appeals Tribunal (New Brunswick). Professor Marin’s teaching and research interests include administrative law, business organization and torts.
