2:00 pm – 3:30 pm Recent Developments in Federal Enforcement and Related Litigation
Case studies focussing on evidentiary, procedural and sentencing/valuation issues in recent federal environmental enforcement matters and a related civil class action:
- Prairie Mines & Royalty’s guilty plea and sentencing to a $3.5 million fine and a rehabilitation order for two charges under the Fisheries Act relating to a tailings release into the Athabasca River will be discussed by the federal prosecutor and a Department of Justice counsel
- Volkswagen AG’s guilty plea and sentencing to a $196.5 million fine for 60 charges under Canadian Environmental Protection Act, 1999 (for importing vehicles which contravened prescribed emissions standards) and related issues will be discussed by the federal prosecutor
- Related Dieselgate consumer class action against Volkswagen (settled for over $2.5 billion) will be discussed by class action counsel
