This joint program will explore issues relevant to managing a cartel file from both the civil and criminal perspective. The panellists will discuss the revised Immunity and Leniency programs released in Fall 2018, including how they affect decision-making and the impact on class actions;  disclosing potentially incriminating information to the Competition Bureau, including managing disclosure risks; issues plaintiff counsel consider when commencing class proceedings; proffers and other cooperation provisions in settlements; recent judicial commentary on court approval of settlements in competition cases; and issues at the intersection of Canadian and US proceedings, including working with US counterparts and disclosure of records produced in US proceedings.
