We are excited to announce the latest installment of our ongoing lunch time “brown bag” series Key Public Sector Cases Across Canada. This upcoming session will focus on the recent Supreme Court Canada decision of Annapolis Group Inc v Halifax Regional Municipality, 2022 SCC 36 where the Court, for the first time since Canadian Pacific Railway Co v Vancouver (City), 2006 SCC 5, reconsidered the test for constructive taking (de facto expropriation) of private property.
We are privileged to have legal experts from local, provincial and federal governments, including the government lawyers who participated in this case, share their views on the potential implications of this ruling on governments.

Susan B. Horne, Legal Counsel, City of Vancouver
Susan is legal counsel for the City of Vancouver and has a broad range of experience in civil litigation, municipal and administrative law. Prior to joining the City, Susan was in private practice in Vancouver for 17 years. During that time she acted as counsel for the City of Vancouver in litigation with CPR, representing the City at all levels of court through to the Supreme Court of Canada’s decision in Canadian Pacific Railway v Vancouver, [2006] 1 SCR 227.
Phong Phan, Legal Counsel, Ministry of Attorney General, BC
Phong Phan is a litigator who has practiced in both Ontario and British Columbia and has appeared before all levels of court in Canada. For the past 10 years, he has been counsel for the Province of B.C. where he advises on expropriation and compensation matters.
Tim Quirk, Legal Counsel, Ministry of Attorney General, BC
Tim is legal counsel with the BC Attorney General. His practice focuses on defending claims for compensation under the Expropriation Act.

Mark is a litigator with the Legal Services Division of the Nova Scotia Department of Justice who practices in the areas of Crown land and expropriation litigation.
Dayna Anderson, General Counsel, Attorney General of Canada
Dayna has practiced litigation with the Department of Justice Canada since 2003. Her practice has been varied and includes residential schools, immigration, tort and breach of contract. For the past 15 years, her practice has focused primarily on resource development litigation, with an emphasis on the duty to consult. Dayna was appointed to the Department’s Supreme Court of Canada counsel list in 2018, and has since participated in seven Supreme Court of Canada appeals. She was also a sessional instructor at the University of Manitoba, Faculty of Law from 2005 to 2009, is a past president of the Winnipeg Philharmonic Choir and is currently a volunteer board member for Palliative Manitoba.
