ADR for Solicitors: Introduction to ADR

Solicitors and litigators alike face pressure from clients to provide cost-effective, practical and timely legal services. Business owners and companies want to resolve their disputes quickly and get back to doing what they do best – running their businesses. Litigation is costly and time consuming, and its remedies can be limiting. Clients want an alternative.

This panel of ADR experts will educate solicitors and corporate counsel about how ADR processes can be used to prevent and resolve disputes regularly encountered by their clients.

Participants will learn:

  • Practical tools for effective dispute prevention for businesses and how these can be built into shareholder agreements
  • Tips on how to draft valid mediation clause (in light of the Supreme Court’s decision in Uber)
  • ADR processes available for business-related disputes, including mediation before and during litigation and arbitration
  • Issues surrounding confidentiality, limitation periods and enforceability, and how these can be addressed in your mediation agreement
  • How to prepare best for a mediation session
