Synopsis

  1. Logistic essentials – platforms, microphones, speakers, and cameras, use of mobile phones and apps - What is recommended and why (focussing on Zoom, which is becoming the preferred platform).
     
  2. How the technology affects the structure of the mediation – Including the use of:
    • breakout rooms
    • document sharing
    • whiteboards
    • shuttle mediation
    • having private conversations with your client over the computer
    • how to exchange chat notes – whether privately with your client, the mediator, other counsel, or to all participants
    • issues of confidentiality with an online format
       
  3. How to prepare your client and yourself as counsel for an effective online mediation.
     
  4. Best practices and ethical issues in mediation using an online format.
     

 

 
About Michael Welsh QC

Michael Welsh, QC was called to the British Columbia bar in 1981 and practises and acts as a mediator and arbitrator in family, commercial and civil law matters. He has been a mediator since 1997. Michael was appointed Queen’s Counsel by the Province of BC in 2017. Based in Penticton, he works primarily in the southern BC interior region including the Thompson-Okanagan and Kootenays, but is happy to travel elsewhere in BC where his services are sought. Holding designations of C. Med. and Q. Arb from ADR Canada, he is a Law Society Certified Family Law Mediator and Family Law Arbitrator and is a civil mediator and arbitrator. Michael is a Fellow of the Chartered Institute of Arbitrators, a member of the Mediate BC Med/Arb Roster, the ADRBC Civil Roster and acts as a mediator for the Law Society in fee disputes between lawyers and clients. Michael is a Bencher of the Law Society of BC, and a Past President of both ADRBC and the CBABC. Between 2017 and 2020 he was appointed by the BC government as a Tribunal Member of the Civil Resolution Tribunal.


About Diane Bell QC
Diane Bell, QC is a partner at Clark Wilson LLP. She is recognized as one of the Best Lawyers in Canada since 2011 in three areas of practice: commercial mediation, family mediation and family law, and has been named by Best Lawyers as Vancouver’s “Lawyer of the Year” for Family Law in 2013 and for ADR and Family Law Mediation in 2015. Diane is also listed in the current Canadian Legal Lexpert Directory as “repeatedly recommended”, attesting to her practical and goal oriented approach to ADR. Diane has garnered a considerable reputation as a formidable mediator with practical business sense. Diane’s mediation practice focuses on dispute resolution of complex financial and often, high conflict cases. She continues her family law practice but it is limited to representation of individuals interested in a discreet and private negotiated settlement. In addition, Diane drafts and negotiates many FLA Agreements.


About Ronald J. Smith QC
At Just Family Solutions, Ron Smith, QC is dedicated to providing cost-effective resolutions of family law legal disputes through arbitration and mediation. Ron graduated from the University of British Columbia law school in 1974, and has practiced in B.C. since 1975.  He was most recently a partner in the law firm Smith Peacock Lawyers in Kelowna, BC.  In 2013, Ron decided to focus his attention on mediation and arbitration to provide the best possible solutions for the Family Law matters of his clients. Ron began practicing mediation in 1985.  He has conducted hundreds of mediations in most areas of law since that time. Ron is a dedicated leader in the British Columbia legal profession. He is a founding Board Member and is a Past Vice-Chair of the B.C. Mediator Roster Society. Ron is also a past Chair and Executive Board Member of the Continuing Legal Education Society of B.C. (CLE). Some of Ron's leadership activities entail teaching and coaching mediation skills for CLE, the Justice Institute of British Columbia, the B.C. Arbitration and Mediation Institute and the National Judicial Institute. Ron is a member of the Mediate BC's Family and Commercial Mediation Rosters.  He is qualified to conduct family mediations and arbitrations through the Law Society of BC.

About Stephen McPhee QC
Stephen McPhee, QC practices in the areas of Civil Litigation, Family Law, and Family Mediation and Arbitration. He has had successful appearances in all levels of court in British Columbia – Provincial, Supreme and the Court of Appeal. Stephen is a highly experienced Family Law practitioner and handles complex financial separations as well as high conflict custody disputes.  He has been appointed as a Children’s Lawyer by the Supreme Court of BC to advocate on behalf of children in family disputes. Stephen has a strong interest in alternate dispute resolution (ADR) and Collaborative Family Law.  He has been the chair of the CBA Nanaimo ADR subsection at various times since 2004. He achieved the Conflict Resolution Certificate from the Justice Institute of BC in 2000 and is a Law Society of BC accredited Family Mediator and Arbitrator.
