New builds are an exciting opportunity for homeowners. There are many enticing elements to the construction process such as home customization and a gradual path to closing. While new construction is often an attractive option for your clients, it involves certain unique issues and challenges to consider for solicitors giving advice. Your buying clients will be presented with a draft Agreement of Purchase and Sale that is much lengthier than the standard OREA form. HST questions will inevitably arise as well as financing considerations and the potential for closing date amendments or delays. The list is long.
As the provincial government moves to enact policy that encourages developers to build more homes, real property lawyers must be prepared to properly advise clients regarding new construction.
Join our panel as they discuss acting as counsel to homebuyers when purchasing from a builder. They will share experiences and tips on:
- Reviewing provisions and concepts that you should expect to see in a home builder’s standard form Agreement of Purchase and Sale;
- Pre-closing issues such as the HST, assignment of Agreements and the standard Tarion schedule; and
- How amendments to the Agreement, including but not limited to closing delays are typically managed.
