In Weilgosh v. London District Catholic School Board, the Human Rights Tribunal of Ontario recently confirmed that it has concurrent jurisdiction with labour arbitrators over the human rights complaints of unionized employees. While this decision maintains the status quo for unionized employees in provincially regulated workplaces in Ontario, it also highlights the Tribunal’s broad deferral and early dismissal powers under the Human Rights Code.
