Involvement in the criminal justice system can have significant implications for an immigration applicant. Under the Immigration and Refugee Protection Act (IRPA), an applicant may be found to be “inadmissible” for numerous reasons including criminality. The Citizenship Act also outlines criminal history that would prevent a permanent resident from obtaining citizenship.

Join us as we bring together immigration and criminal practitioners to unravel the impacts and interactions between criminal and immigration proceedings with a focus on two specific areas:

  • Plea deals and statements of fact: assessing the legal consequences of criminal and immigration outcomes for clients dealing with both areas of the law; and
  • Detention review versus bail hearings: Unraveling the commonalities and differences, and exploring current caselaw for strategies that can be used in both forums.
