In the class action context, it is not unusual to see class actions commenced in other jurisdictions months, or even years, after the initial action was commenced in another jurisdiction. This session will address the challenges that arise from late arriving multijurisdictional class actions. How should plaintiffs and defendants respond to late arriving multiple jurisdictional class actions? Does the plaintiff in the initial action have standing to seek a stay? Are the circumstances where a late arriving class action may be beneficial? What challenges do late arriving class actions present in the settlement context?
