Section 2(c) of the Canadian Charter of Rights and Freedoms guarantees freedom of peaceful assembly. Although this constitutional protection has not yet been fully examined by Canadian courts, its relevance has come into sharp focus in the wake of the COVID-19 pandemic and recent restrictions on public gatherings and group activities. At this important program, our expert faculty will review emerging commentary and jurisprudence on Section 2(c); discuss how section 2(c) is engaged by lockdown orders and how it may inform ongoing constitutional challenges; and consider how governments and policymakers should approach the balancing of public health and freedom of peaceful assembly.
