Bills 148 and 47 reconciled who must prove employee status in the event a person is misclassified as an independent contractor pursuant to a claim under the Employment Standards Act. These shifts in statutory employment law recognize the independent contractor’s place in Ontario’s new economy, where the standard employment relationship is declining and non-traditional work arrangements are growing.
