Bills 148 and 47 reconciled who must prove employee status in the event a person is misclassified as an independent contractor pursuant to a claim under the Employment Standards Act. These shifts in statutory employment law recognize the independent contractor’s place in Ontario’s new economy, where the standard employment relationship is declining and non-traditional work arrangements are growing. Ensure you are up to date on the current state of the law of independent contractors and explore developments in class action litigation as a strategy for resolving claims of employees being treated as independent contractors.
