Is three a company or a crowd? The tripartite relationship in an insurance defense practice involves defense counsel, the insurer and the insured. In certain situations, an insurer is obligated under an insurance policy to designate, direct and/or reimburse counsel for the defense of an insured. As a result, insurance defense is unique in that counsel has two clients: the insured and the insurer. While in the normal course the three parties work together to achieve a common goal, situations can arise where they have misaligned interests that can lead to complexities for defense counsel to navigate. Our experienced faculty explore the tripartite relationship as well as some ways to manage it effectively.
