Criminal cases frequently involve multi-faceted legal issues. Whether a seemingly straightforward sexual assault case, or a homicide, Crown and defence counsel often wrestle with disclosure problems, complex evidentiary issues, and various ethical and strategic considerations.
In bringing a s. 276 or 278 application, what is the defence obliged to put before the Court? What is the Crown obliged to disclose to the defence? How should the Crown prepare vulnerable or “uncooperative” complainants and witnesses, and what are the boundaries of examination-in-chief and cross-examination?
