The impact of the COVID-19 pandemic, mandated court closures, limitations on individuals and businesses, and the coming expiry of governmental assistance programs are going to mean an upsurge in insolvency filings.  The impact that these will have on other areas of law and practice will be significant, and the first and one of the more critical impacts will be the stay of (most) proceedings against the insolvent person.

Our experienced panel will provide a practical overview intended for practitioners who have little or no experience in the insolvency area, covering the following key considerations:

  • The impact of stays under insolvency statutes
  • The difference between the stays that apply in bankruptcy, proposal, receivership and CCAA proceedings
  • The reasons a stay may or will be lifted
  • Emerging areas of concern or controversy in the extent and application of stays
