OBA Alternative Dispute Resolution PROGRAM | Original Program Date: June 24, 2020
The Ontario Superior Court of Justice recently issued a practice direction encouraging lawyers to conduct virtual mediations wherever possible during the suspension of in-court matters. There has also been a recent shift in Alternative Dispute Resolution (ADR) where more often, mediators, lawyers and parties are conducting dispute resolution online. Now that we have become familiar with the various online platforms, join our stellar faculty who will discuss some of the complex challenges with virtual ADR and provide you with practical guidance for navigating those challenges. We will cover key considerations, including:
- Risk, liability and negligence issues which may arise from online dispute resolution, and how to mitigate those risks
- How power imbalances and relational dynamics between parties can be impacted by the virtual setting
- The privacy and information security considerations to safeguard against in online dispute resolution.
