This program brings together counsel working on two headline-grabbing cases involving gender and gender identity in the courts. Our speakers will address:
- Olympic champion Caster Semenya’s case before the Court of Arbitration for Sport, which involved the eligibility of women athletes with elevated levels of naturally occurring testosterone to compete in the women’s category in athletics, and
- The Centre for Gender Advocacy (“CGA”)’s constitutional challenge of Quebec laws regulating civil status on the basis of gender identity and gender expression
Carlos Sayao acted as counsel to Caster Semenya before the Court of Arbitration for Sport, while Michael Lubetsky acted as counsel to Égale Canada in the CGA case before the Superior Court of Quebec. Hear from them as they discuss key substantive and procedural issues raised when challenging laws and regulations on the basis of gender, as well as gender identity and expression.
