Join us for this unique series where past winners of the OBA Murray Klein Award discuss precedent-setting cases in which they were involved, or new concepts and practices in Canadian insolvency and restructuring law where they were at the forefront. This award recognizes Ontario insolvency and restructuring lawyers for their integrity, decency and selflessness in their approach to professional practice. Each panel in this not-to-be-missed series will also consider how concepts introduced in years past have evolved.

Part 3 of the Series:

From the Brink - Asset Backed Commercial Paper and 3rd Party Releases

The market for asset backed commercial paper froze at the outset of the 2008 financial crisis, leaving more than $32 billion of asset backed commercial paper in limbo  and leading to the largest and most complicated financial restructuring in Canadian history.  These panel members were on the front lines and will discuss the imaginative use of the Companies’ Creditors Arrangement Act to craft an innovative solution using what were then seldom-used tools, such as third party releases.
