Vapour intrusion (VI) is about an exposure pathway and the volatilization of contaminants in soil and groundwater that migrate to indoor air. VI exposes occupants of buildings to potentially harmful contaminant vapours arising from exposure to volatile and semi-volatile contaminants. These chemicals include degreasing solvents, dry cleaning chemicals, petroleum products, naphthalene, PCBs and others. The investigation and management of risks to human health associated with VI is becoming much more of a focus for contaminated land owners, brownfield redevelopers, banks, insurers, landlords and tenants, and their Qualified Persons. Regulators throughout North American have been grappling with how best to regulate VI. VI was an important driver in the development of Ontario’s more stringent MOE Soil, Ground Water and Sediments Standards (revised April 15, 2011). In 2010, Health Canada published Federal Contaminated Site Risk Assessment in Canada, Part VII: Guidance for Soil Vapour Intrusion Assessment at Contaminated Sites. In Ontario, the MOE published a draft Technical Guidance titled Soil Vapour Intrusion Assessment dated November 2010. Ontario’s guidance document remains in draft despite the MOE’s use of it in the Record of Site Condition regulatory process. Our legal and technical speakers will explore where vapour intrusion fits within the law of contaminated sites, and how to investigation, manage and mitigate vapour intrusion risks.
